Terms of Service

Please read these Terms carefully before using WaiverCarePro. By using the platform you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using WaiverCarePro ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Platform.

2. Description of Service

WaiverCarePro is a cloud-based practice management platform for Home and Community Based Services (HCBS) Medicaid providers. The Platform provides tools for caregiver scheduling, Electronic Visit Verification (EVV), billing and claims management, authorization tracking, compliance monitoring, and staff coordination.

3. SMS Messaging Program

Program Name: WaiverCarePro Notifications Description: By enabling SMS notifications in your account settings, you consent to receive automated text messages from WaiverCarePro. Message types include shift reminders, scheduling alerts, authorization expiry notices, compliance credential reminders, and visit verification confirmations. Message Frequency: Message frequency varies based on your schedule, agency activity, and notification preferences. You may receive multiple messages per day during active scheduling periods. Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details. Opt-Out: Reply STOP to any message to unsubscribe from SMS notifications. You will receive a confirmation message and no further messages will be sent. You can re-enable SMS notifications at any time under Settings → Notifications in the platform. Help: Reply HELP to any message for assistance, or contact support at support@waivercarpro.com. Supported Carriers: Compatible with all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier support is not guaranteed for all carriers. WaiverCarePro will not share your phone number with third parties for marketing purposes.

4. Account Registration

You must create an account to use the Platform. You agree to: • Provide accurate, current, and complete information during registration • Maintain and update your information to keep it accurate • Keep your password confidential and not share access credentials • Notify us immediately of any unauthorized access to your account • Be responsible for all activity under your account You must be at least 18 years old to create an account.

5. HIPAA and Protected Health Information

The Platform processes Protected Health Information (PHI) as defined by HIPAA. By using the Platform for PHI, you agree to execute a Business Associate Agreement (BAA) with WaiverCarePro. Enterprise customers may request a BAA from support@waivercarpro.com. You are responsible for ensuring your use of the Platform complies with all applicable HIPAA requirements for your organization.

6. Acceptable Use

You agree not to: • Use the Platform for any unlawful purpose or in violation of applicable regulations • Submit false or fraudulent Medicaid claims or EVV records • Attempt to gain unauthorized access to the Platform or other users' accounts • Transmit malware, viruses, or other harmful code • Use the Platform in a way that could damage, disable, or impair its operation • Reverse engineer, decompile, or attempt to extract the source code of the Platform

7. Subscription and Payment

Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in suspension or termination of your account.

8. Intellectual Property

WaiverCarePro and its licensors own all rights to the Platform, including software, design, trademarks, and content. These Terms do not grant you any ownership rights. You retain ownership of data you input into the Platform. You grant WaiverCarePro a limited license to use your data solely to provide the service.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WAIVERCARPRO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAIVERCARPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with notice. Upon termination, your right to use the Platform ceases. Data export options are available for 30 days after termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or sending an email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
